Template License

This license governs your use of a PrimeTek template (“the Item”). PrimeTek Informatics (“PrimeTek”) owns the Item and grants you a license under the terms below. By purchasing or using the Item, you agree to these terms.

License Comparison

Choose Basic if you are building a single product that you will not sell directly. Choose Extended if you are selling the End Product, charging end users, or building multiple products.

Who Needs a License

A template license is purchased per organization. One license covers your organization’s use of the Item to build the End Product(s) permitted by your license edition. The developers on your team building that End Product work under the same organizational license; you do not need a separate license per developer.

You may not share the Item across separate organizations, and a license may not be resold or transferred without PrimeTek’s consent.

Basic License

1. The Basic License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to use the Item you have selected.
2. You may use the Item to create one single End Product for yourself or for one client (a “single application”), and that End Product may be distributed for free.
3. An “End Product” is a customized implementation of the Item. For example, the Item is a website template and the End Product is the finished website customized with your content.
4. You may create one End Product for a client, and you must document the license terms of the Item in the End Product distribution.
5. You may make any number of copies of the single End Product, as long as it is distributed for free.
6. You may modify, adapt, and combine the Item with other works to create a derivative work, as long as the resulting End Product is permitted under clause 2.
7. You may charge a single client for the work on the End Product. If you or your client want to sell the End Product, you need the Extended License.

What You Cannot Do (Basic)

• Redistribute the Item as stock, in a tool or template, or with source files, whether on its own, bundled, or modified. You cannot make the Item available as-is or with superficial modifications. For example, you cannot purchase a template, convert it to an HTML template, and sell or give it to more than one client.
• Use the Item in any application that lets an end user customize a product to their needs (“on demand,” “made to order,” or “build it yourself”), such as a website builder, unless you purchase a separate license for each final product created with it.
• Allow an end user of the End Product to extract the Item and use it separately.
• Use the Item in a logo, trademark, or service mark.

Extended License

1. The Extended License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to use the Item you have selected.
2. You may use the Item to create multiple End Products for yourself or for multiple clients, and those End Products may or may not be sold.
3. An “End Product” is a customized implementation of the Item. For example, the Item is a website template and the End Product is the finished website customized with your content.
4. You may create multiple End Products for multiple clients, and you must document the license terms of the Item in the End Product distributions.
5. You may sell and make any number of copies of the End Products.
6. You may modify, adapt, and combine the Item with other works to create a derivative work, as long as the resulting End Product is permitted under clause 2.
7. This is a multi-use license, not a single-application license, which means you can use the Item to create more than one unique End Product.

What You Cannot Do (Extended)

• Redistribute the Item as stock, in a tool or template, or with source files, whether on its own, bundled, or modified. You cannot make the Item available as-is or with superficial modifications. For example, you cannot license an item and then make it available as-is on your website for users to download.
• Use the Item in any application that lets an end user customize a product to their needs (“on demand,” “made to order,” or “build it yourself”), such as a website builder, unless you purchase a separate license for each final product created with it.
• Allow an end user of the End Product to extract the Item and use it separately.
• Use the Item in a logo, trademark, or service mark.

Terms That Apply to Both Licenses

Third-party components. For some Items, a component is sourced from elsewhere and different license terms may apply to that component (for example, another party’s license, an open source license, or a Creative Commons license). When this is the case, the component is identified on the Item’s description page or in its downloaded files, and the other license applies to that component instead of this one. This license applies to the rest of the Item. For example, a theme might contain images licensed under Creative Commons CC BY; that license applies to those images, and this license applies to the rest of the theme.

Lawful use. You may only use the Item for lawful purposes. If an Item contains an image of a person, even if model-released, you may not use it to create a fake identity, imply personal endorsement, or in any way that is defamatory, obscene, demeaning, or connected with sensitive subjects.

Termination. This license may be terminated if you breach it. If that happens, you must stop copying and distributing the End Product until you remove the Item from it.

Ownership. PrimeTek Informatics retains ownership of the Item and grants you the license on these terms. This license is between PrimeTek Informatics and you.

Modification of Terms

PrimeTek may modify these terms at any time. Changes apply to purchases and continued use after the revised terms are published. We make reasonable efforts to notify users of material changes, but you are responsible for reviewing the terms periodically.

Modifications do not affect your right to use versions of the Item you have already received. Future updates, support, and services are governed by the terms in effect at that time. Unless specified in a signed written agreement, PrimeTek has no obligation to provide updates or support beyond the period stated in our current policies.
